MMR & R ACT 1957 Development and Regulation Act


Mines and Minerals Development and Regulations Act 1957:

  • To develop and regulate the grant of Mineral Concessions, exploitation of minerals and compliance to the conditions and stipulations laid down in the lease deed including payment of royalty and compounding of offences. The powers are vested with J&K UT Government and has been delegated to Director Geology and Mining as and when required.

Mineral Concession Rules, 1960:

  • Framed by central government for grant of mineral concessions for Major Minerals.

J&K Minor Mineral Concession Rules 1962:

  • Framed by State Government for grant of Mineral Concessions for Minor Minerals has now been replaced with SRO-105 Dated 31st of March-2016

Mines and Mineral Conservation and Development Rules 1988:

  • Conservation and development of mineral in accordance with the Mining Plan, Progressive Mine Closure Plan for fresh leases and scheme of mining and progressive mine closure plan for existing leases (to be reviewed after five years).
  • Employment of statuary persons for conducting mining operations.
  • The powers to regulate and compounding offences are vested with controller of Indian Bureau of Mines, Government of India.

Checklist for grant of Mining lease which can be applied through Online also:

  • Application in Form-I to be filled by the applicant in triplicate.
  • Site plan covering boundaries of applied area with Geo-coordinates.
  • Revenue papers, Jamabandi, Girdawari, Khasra Original in triplicate.
  • Title verification certificate of the land from Revenue Department duly attested by the Deputy Commissioner. concerned
  • Royalty clearance, income tax clearance and non holding of mining lease or affidavits in this regard.
  • NOC’s from Forest, Wildlife, Pollution Control Board and District Administration.
  • Consent of the owner/occupier of the land if area does not fall in the J&K UT Government lands.
  • Mining plan approved by Indian Bureau of Mines (IBM).

Checklist for grant of composite licensee:

  • Application in Form-I to be filled by the applicant in triplicate.
  • Site plan covering boundaries of applied area.
  • Revenue papers, Jamabandi, Girdawari, Khasra Original in triplicate. after title verification of land issued by the Deputy Commissioner concerned
  • Consent of the owner/occupier of the land if area does not fall in the J&K UT Government land.
  • Consent from the Prospector having qualification M.Sc. Geology or B.E.Mining.

Besides the Department during the year 2021-22 has reprinted SRO-105 after incorporation of all the previous amendments issued by the Government by various SO’s from time to time.
